Your agreement with Warm Path

Terms of Service

Last updated

The conditions for using Warm Path, creating with your own material, making a purchase and getting help. Mandatory consumer and privacy rights remain yours.

What this agreement covers

LMH BACKYARD BUZZ LLC provides Warm Path: AI Video Studio. Our address is 6279 S Westridge St, Salt Lake City, UT 84107-7759, United States, and our public contact is support@warmpath.net. These terms cover the Warm Path app, the information at https://www.warmpath.net, and the support we provide for those services.

Warm Path is an Android app for turning images into videos, working with video templates and generating AI images. The app is in development and its Google Play release is coming soon. This website does not offer a download, accept payments or receive material for generation. Artwork identified as a concept illustrates a creative direction; it is neither an app screenshot nor an example produced by Warm Path.

An available feature or purchase can have additional conditions presented before you use or buy it. Read those specific conditions with these terms: they describe the particular offer without removing mandatory rights or promises already made about a purchase. A description of future availability does not make an unreleased feature available for use today.

Who may use the app

You must have the legal capacity to agree to these terms and meet the age, permission and other requirements that apply in your location and through the distribution platform. Where local law permits use with a parent or guardian's involvement, obtain the required permission and supervision. Store age ratings and rules also apply; they are not a replacement for a legal requirement that applies to you.

If you act for a business or another organisation, you must have authority to accept the applicable obligations for it. Using an employer's device or payment method does not by itself establish that authority. You remain responsible for ensuring that you may submit the material and authorise any purchase involved.

Availability can depend on lawful distribution, compatible devices and local restrictions. Being able to open this website does not establish eligibility to use every app feature in every country. Do not access a feature or complete a transaction where doing so would be unlawful, and contact support if an eligibility restriction appears to have been applied incorrectly.

Using Warm Path without a login

Warm Path does not require you to register or sign in to a Warm Path account. Information associated with an app installation or use of the service can still be needed to operate it, associate a request with a result or resolve a purchase problem. A Google account used for Google Play belongs to Google's separate service; it is not a Warm Path login.

Take reasonable care of the device and store payment access you control. Reinstalling the app, clearing its data or changing devices can affect locally available information and our ability to match a service record. Keep exported creations you want to retain and your purchase receipts. If paid access is missing, contact us so the relevant purchase can be checked; these terms do not promise that a specific recovery or transfer method is available.

For support, describe the problem honestly and give correct, available order references. Say when a detail is unknown rather than guessing. Let us know if you suspect unauthorised use of your device-related service records or paid benefits. This requirement concerns support and purchase information, not creative expression: imaginative prompts and fictional scenes do not have to describe real events.

Rights in what you bring and create

You retain the rights you already have in images, prompts and other material you supply. You must have the permissions needed to use that material for the requested creation, including relevant copyright, privacy and likeness permissions. Permission to possess a photograph does not necessarily include permission to generate or publish a new depiction of the people in it.

We do not take ownership of your inputs or claim ownership of a result merely because Warm Path processed it. This does not create rights that the law does not recognise: AI output may not qualify for copyright protection, may resemble other work and may not be exclusive. A template can also contain components subject to the conditions shown for that template. Check applicable rights before publishing or using a result commercially.

Review your results for accuracy, unwanted details and effects on others. You decide how to use or distribute them, subject to these terms and applicable law. Do not present synthetic material as authentic evidence, misrepresent another person's involvement or omit a disclosure that the law or your publication platform requires. Generating a result is not legal clearance for its later use.

The permission needed to fulfil a request

By submitting material, you allow us to receive, process, temporarily store, transmit and deliver it as needed to fulfil your request and provide related support and safety handling. This permission is non-exclusive and limited to those service purposes. It does not transfer ownership, authorise unrelated publication of private inputs or allow us to sell your creative material. Only the operational access needed for the stated purposes is permitted.

Generation runs on servers we host and control. We do not send requests to third-party AI generation providers, perform facial recognition or extract biometric identity information. We do not use any user data to train AI, including inputs, results, support messages, purchase information and other service records. Permission to process a creation is not permission to train a model.

All information about a creation is deleted within 36 hours from the start of its upload, or from submission of the prompt when there is no upload. This covers inputs, outputs, prompts, settings, task identifiers, status, timestamps, metadata, associations and every copy in controlled systems or systems processing for us, including logs, support attachments, caches and backups. Completing a result, copying it or opening a support case does not restart that clock.

Necessary independent financial, support or security records must not preserve creation information or links to it beyond that deadline. Warm Path is not a permanent archive. General suggestions you voluntarily send may help us improve the service without a promise of payment, but sending feedback does not transfer unrelated intellectual property or change our data-use restrictions. Avoid including confidential third-party material in an unsolicited suggestion.

Content and conduct we do not permit

Use Warm Path lawfully and respect other people's safety and rights. Do not request, upload, generate or distribute material through the service for any of the following purposes:

  • Sexual exploitation or abuse of children, sexualised depictions of minors, pornography or non-consensual intimate imagery, including fabricated intimate depictions of a real person.
  • Credible threats, targeted harassment, hateful abuse, violent extremism, or material encouraging self-harm or violence against others.
  • Fraud, scams, phishing, deceptive impersonation, fabricated identity or evidence, or misleading people about civic participation or another consequential real-world event.
  • Infringement of intellectual property, privacy, likeness or other rights, or disclosure of confidential information without authority.
  • Malware, unauthorised access or security testing, disruption, deliberate excessive load, manipulation of payment or entitlement records, or attempts to bypass payment, access limits, safety controls or a lawful restriction.
  • Unauthorised scraping, resale of service access, or extraction, copying or reverse engineering of protected software or models, except to the extent a mandatory legal right or applicable component licence permits it.

Use the report option on a creation's detail page to report problematic content without leaving the app. Email support is an additional reporting route. We use reports to address content safety and filtering; reporting does not authorise retention beyond the creation-data deadline. Identify the concern without forwarding illegal material or unnecessary private information. A report is assessed on its merits and is not proof that a violation occurred.

Privacy and control of source images

The Privacy Policy explains the information used to operate Warm Path, the reasons for processing, disclosures, security, retention and your rights. The AI Data page gives additional detail about creation processing. These notices apply alongside this agreement, but referring to them does not obtain a consent that must be requested separately. Accepting terms does not waive a privacy right.

Warm Path uses the Android system Photo Picker for you to select source images. Select only material needed for the creation, and avoid unnecessary sensitive or confidential information. An image can contain personal information even though we do not identify faces or derive biometric identities from it. Check that you are entitled to provide images of other people.

Private source material is not made public merely by submission. Access and operational or legally required disclosures are limited to the purposes explained in the Privacy Policy. You should still review what you supply and where you later share an exported result. A file you deliberately send to another service will be subject to that service's own handling.

Requesting deletion

Use the deletion option in Personal Settings or send a request to support@warmpath.net. These are independent routes: you may email when the app is unavailable or you no longer have it. You do not need to create a Warm Path login or reinstall the app to make a request. We may need proportionate information to locate the records and verify that the request concerns you.

Deletion covers app-user data and records associated with your creations, not just the final image or video. The ordinary creation-data deadline applies without a request. Save results you need before deletion; an erased record cannot be used to recover them. Separately downloaded or shared files, and records held independently by Google, are outside this deletion process.

Limited independent records may remain where needed for accounting, payment disputes, fraud prevention, security or another legal obligation. They must not keep creation content, metadata or associations beyond its deadline, or be used to resume ordinary use of an erased app-user record. Deleting Warm Path data does not delete your Google account or automatically request a refund. A purchase enquiry and a deletion request may proceed together; resolving one is not a prerequisite for requesting the other.

Before making a purchase

Warm Path may offer paid features or benefits in the app. Prices are not published on this website, and there is no website checkout. Before authorising a purchase, read the price, currency, applicable taxes, benefit supplied and any relevant usage conditions shown in the app and the Google Play purchase process. A general feature description does not itself promise a free allowance or a particular paid entitlement.

Only authorise a purchase with a payment method you are entitled to use. Google Play operates its checkout and payment-record processes under its own applicable terms. We use the purchase confirmation necessary to supply the corresponding Warm Path benefit; we do not ask you to send full payment-card information, a Google password or a verification code to support.

The offer accepted at purchase determines what is supplied and any clearly disclosed limits on its use. Check those conditions before deciding to pay. We cannot replace an accepted purchase description retrospectively with a less favourable website description. If the displayed offer is unclear, or the purchase does not provide what was described, contact support with the available order reference.

Separate purchases and delivery of benefits

Warm Path does not offer subscriptions. Each purchase is a separate payment for the offer you choose; making one purchase does not authorise another payment later. The app shows the conditions of that offer before confirmation. Each offer identifies the benefits you are buying and any conditions or limits that apply.

Keep the store receipt so a payment can be distinguished from another transaction. A pending charge, unsuccessful checkout and completed order can require different handling. If the app does not show a benefit associated with a completed payment, provide the available order reference and explain what is missing. Support can review the mismatch without requiring a Warm Path registration or your store credentials.

Do not assume that repeatedly attempting payment will repair a delivery problem. If more than one charge appears for an intended single purchase, explain that issue so the relevant transactions can be checked. You remain entitled to the accepted benefit or an applicable remedy. Our ability to verify a payment is not permission to keep payment for something we have not supplied.

When a purchase needs correction

Contact support about missing paid access, an apparent duplicate charge, a failed paid service or another mismatch with the purchase description. For an unauthorised Google Play charge, the store also provides a reporting route. Use the process appropriate to the transaction and describe what happened accurately; where information is unavailable, say so. You may ask for help without giving up a statutory remedy.

Refund eligibility can depend on the purchase, circumstances, store rules and applicable law. The Refund Policy explains these routes. We do not label every digital purchase non-refundable, promise approval of every request or replace a legal right with a shorter discretionary store window. Google and the payment provider control parts of the refund processing and return of funds.

An approved refund or payment reversal may remove or adjust the corresponding paid benefit. Any adjustment must match the transaction concerned and respect mandatory rights; unrelated valid purchases are not automatically forfeited. Tell support if the adjustment is wrong or the decision is not reflected correctly. We may investigate credible payment abuse proportionately, but making a legitimate claim or challenging an error is not abuse.

The app, its components and its identity

Rights in Warm Path's software, models, interface, documentation, website presentation, names and brand materials belong to us or the relevant rights holders. Permission to use the service gives you access to its functions under these terms; it does not transfer ownership of those underlying materials or give you a right to operate a competing copy of the service.

Do not copy or exploit protected app or website material beyond the permission granted, remove ownership notices, or use our name and visual identity in a way that falsely suggests authorisation or endorsement. These restrictions concern the service and its protected components. They do not take away rights you hold in your own material or prevent lawful use of a result simply because you exported it from Warm Path.

A component may carry a separate licence, and applicable law may permit an act despite a contractual restriction. Those permissions remain available to the extent they apply. Contact support if you need permission for a proposed use of Warm Path's own materials; a public website or downloadable app is not a general licence to reproduce its identity.

Permission to run the mobile software

When the app is available through an authorised distribution route, you receive a limited, non-exclusive permission to install and run an authorised copy on a compatible device you control, for use of the service under these terms. This permission does not allow sublicensing, rental, sale of app copies, repackaging or redistribution as your own product.

Do not modify protected components, remove security controls or circumvent access restrictions. Statutory rights and permissions in an applicable component licence remain unaffected, including any lawful exception to a restriction on examining or interoperating with software. You must not use such an exception as a pretext for conduct beyond what it permits.

The app requires an appropriate device, supported software and a working connection for server processing. You are responsible for charges imposed by your connectivity or device provider. Operating-system and Google Play requirements can also affect use. Updates may be needed for security, compatibility or continued operation; this is not a promise to support every device or system version indefinitely. Paid rights affected by a material change remain subject to the protections below.

Stores, operational providers and external links

Google Play provides distribution and purchase services, while hosting and communications providers can support website delivery and assistance. Adjust is used only to understand installation sources through necessary technical attribution information. We do not send it creative material, support content or purchase events. These operational uses are separate from generation: no third-party AI provider processes a Warm Path generation request.

The website does not use analytics or third-party fonts. An external site you choose to visit, including a store help page, has its own terms and privacy practices. Its operator controls its content, decisions and availability. A link is not an endorsement of everything on that site, nor does a provider's involvement relieve us of obligations we have to you.

If an offer from another provider is presented, check the provider's identity and the conditions before participating. That provider is responsible for its own offer unless we expressly undertake an obligation; statements and promises we make remain subject to applicable consumer law. Following a link or taking an offer does not by itself authorise unrelated marketing or optional tracking.

What generation can and cannot promise

AI generation involves uncertainty. A result can contain visual defects, inaccuracies or unexpected details, and similar requests can yield different results. It can also resemble material created by other people. Submitting a request does not guarantee factual accuracy, a particular aesthetic, exclusivity, copyright protection or success in a commercial project.

Website concept images are illustrative artwork, not screenshots of a released interface or results generated by this app. They do not promise a particular result for your request. Read the description of the actual feature and any paid offer when it becomes available, then review outputs before publication or use. Do not rely on generated images or video as authoritative evidence of real events.

These limitations do not override the description of an accepted purchase or the service standards required by law. Where applicable, digital content must conform to its description and legally required quality standards, and services must be delivered with reasonable care and skill. A valid claim can give rise to correction, repeat performance, a price reduction or a refund. AI uncertainty is not a reason to disregard such a claim.

Maintenance and changes to the service

Operating Warm Path can require maintenance, security improvements, compatibility work and changes to meet legal or marketplace requirements. Availability can also be affected by network conditions and events outside our reasonable control. We do not promise uninterrupted access, a fixed processing time or compatibility with every device, browser and operating-system version.

We may develop, replace or withdraw features for legitimate operational or product reasons. If a change materially affects something you have already paid for, the purchase conditions and applicable law determine the notice and options due to you. An urgent security or legal issue may require action before advance notice is possible; urgency does not extinguish a right to an appropriate remedy.

If a change or permanent withdrawal leaves a paid obligation unfulfilled, contact support. Depending on the circumstances, the appropriate response may be restoration of the benefit, an end to the affected purchase arrangement or a refund. A general ability to improve the service does not allow us to retain payment while disregarding what we agreed to supply. Creation-data deletion continues during changes or interruptions.

Restrictions and the end of use

You may stop using Warm Path at any time. We may reject a request, restrict a feature or suspend or end access where reasonably necessary because of a serious breach, fraud, a security threat, a legal requirement or non-payment affecting the particular benefit. Measures should be proportionate to the reason for taking them, rather than an automatic loss of unrelated rights.

Where appropriate and legally permitted, we will explain a restriction and provide a way to raise a mistake with support. Protective action may need to happen before notice, and information may be limited where disclosure would undermine security or breach the law. A good-faith complaint, privacy request or valid refund request is not itself a reason to penalise a user.

When permission to access a restricted service ends, stop attempting to use it or bypass the restriction. Obligations relating to existing purchases, rights in material, lawful record handling and unresolved claims continue where their purpose requires it. Ending access does not remove privacy or consumer remedies, extend retention of creations or turn private content into material we may use for another purpose.

Responsibility for loss or damage

We remain responsible for obligations imposed on us by the agreement and applicable law. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other responsibility that cannot lawfully be excluded or limited. A statement about uncertainty or availability must be read with those protections.

For consumers, responsibility for loss is assessed under the applicable rules, including causation and reasonable foreseeability where relevant. We cannot rely on a general AI disclaimer to avoid a failure to supply what was agreed. Equally, an independent publishing decision or misuse wholly outside our responsibility does not automatically make us liable for every consequence of using a result.

Take reasonable precautions, such as reviewing a creation, checking permissions and retaining exported files that matter to you. Those precautions do not excuse loss to which our own conduct contributed. Warm Path does not promise revenue, audience growth, profit or another business outcome. If you use it commercially, that absence of a promised outcome applies alongside any specific agreement and mandatory protections.

Complaints about another person's rights

You are responsible for your own unlawful actions and the liability the law places on you when using or publishing material. A complaint may concern copyright, privacy, a person's likeness or another protected right. We may ask for relevant information about your connection to the material or evidence of permission to understand the complaint and protect those affected.

If deliberate unlawful conduct or a material breach by you causes a valid third-party claim against us, recovery from you is limited to loss the law permits us to recover. This is not an unlimited promise to defend us, fund every allegation or indemnify us for our own wrongdoing. Responsibility depends on the facts and applicable law, not merely on a complaint having been submitted.

If you believe a restriction or complaint is mistaken, contact support and explain why. Provide enough detail to identify the issue without sending illegal material or unnecessary private data. Complaint handling does not create an exception to the creation-data deadline, including for attachments or task references; any independently retained record must be stripped of creation information and associations.

Resolving disagreements and applicable law

You can raise a service or purchase problem with support@warmpath.net, including the reference you have and the outcome you are seeking. We can try to resolve it through support. That option is not a requirement to exhaust an internal process before using a store review procedure, regulator or court when you have the right to do so, and it does not pause a legal deadline.

These terms are governed by the laws of the State of Utah, United States, where our company is based, without regard to conflict-of-law rules. Mandatory protections available to consumers in their place of residence remain effective, and nothing in this choice of law removes them. These terms do not select an exclusive court, require compulsory arbitration or make a consumer surrender an otherwise available local forum or remedy.

A dispute about a store decision may also be raised through the store's own review channel. Data-protection requests and complaints can be made using the routes in the Privacy Policy and to an appropriate authority. Using a lawful complaint or dispute process is not a breach of these terms. Keep relevant purchase records so the transaction in question can be identified without preserving unnecessary creative material.

Trade restrictions and lawful access

Applicable export controls, sanctions and trade restrictions govern access to and transfer of software and services. Do not use Warm Path for a prohibited transaction, provide access to a person who may not lawfully receive it, or transfer restricted software or services to a prohibited destination. The fact that a connection succeeds does not establish that a transaction is authorised.

We may restrict access where necessary to meet such a legal obligation. Do not circumvent a restriction through another identity, payment method, device or intermediary. If you believe a restriction has been applied in error, you may contact support; any review remains subject to the law and does not promise access where it is prohibited.

Notices and electronic records

Service information may be provided in the app, on this website or in a support email exchange you initiate. Google Play can separately issue receipts and transaction notices. Keep a copy of important purchase descriptions, accepted conditions and correspondence when you need a record of what was agreed; a store receipt and a Warm Path support reply serve different purposes.

Electronic confirmations and records may communicate notices and evidence an agreement to the extent the law permits. Where another form of notice is legally required, that requirement still applies. Posting a general notice does not substitute for an individual notice required for a particular change or transaction.

These communication arrangements do not sign you up for marketing, authorise optional tracking or replace a separate privacy consent. Sending a question allows us to respond to that question and manage the related support matter as described in the Privacy Policy, rather than to use the exchange for unrelated advertising or AI training.

Consumer protections where you live

Local law may provide rights concerning digital content quality, conformity, warranties, withdrawal from a purchase and refunds. Mandatory protections take priority over inconsistent wording here. Relevant protections in the United States, United Kingdom, European Union and other places apply where their legal conditions are met; identifying those protections does not change the location or identity of the operator.

If a statutory withdrawal period applies, a request to begin supplying digital content or services early must be handled through the purchase process with the information, express request or consent and acknowledgment required by the relevant law. Simply visiting this site, reading the terms or viewing an illustration does not waive that right.

Faulty, misdescribed or unsupplied content can give rise to remedies even after an ordinary discretionary store refund window has passed. Store policies can add options but do not remove statutory ones. Tell support or the relevant store about the actual issue so it can be considered under the applicable rules, without assuming that every dissatisfaction necessarily establishes a defect.

The agreement as a whole

These terms, the applicable feature and purchase conditions, and the linked notices explain the arrangements for Warm Path. Binding information supplied before a purchase remains part of the arrangement where the law requires. No statement that the agreement is complete erases a consumer's reliance on information that legally binds us. Privacy notices describe handling of information and do not themselves obtain a separate consent.

If a term cannot lawfully be enforced, the remaining terms continue to operate to the extent permitted, without using that rule to defeat a mandatory protection. A failure or delay in enforcing a provision does not automatically waive the ability to address a later breach. Any lawful waiver is limited to its circumstances.

You may not transfer permission to operate or resell the service without authorisation. If the business or an agreement transfers to a successor, existing obligations, privacy protections and mandatory rights must be respected. A transfer is not a way to reduce paid benefits or reuse private content for an incompatible purpose. Notice and any further steps required by law remain necessary.

Changes to these terms and how to contact us

The date shown for these terms identifies the current version. We may revise them to reflect service changes, legal requirements or operational developments. A material change will receive the notice or fresh agreement required by applicable law. Updating a webpage does not retrospectively remove a purchase right or authorise a new use of personal information that requires a separate legal basis or consent.

Where conditions differ for a future offer, they must be available before you decide to accept that offer. Existing transactions remain protected by their accepted conditions and mandatory law. Contact us if the version relevant to a purchase or a change affecting it is unclear; keeping the store receipt and relevant offer information can help identify it.

Questions about the agreement can be sent to support@warmpath.net. The provider is LMH BACKYARD BUZZ LLC, 6279 S Westridge St, Salt Lake City, UT 84107-7759, United States. Our support page explains how to raise a product, purchase, deletion or content concern while keeping unnecessary personal material out of the request.

Before you proceed

Read the conditions that apply to a feature or purchase before using it. When the app or an applicable purchase flow asks you to accept terms, your acceptance relates to the conditions presented there. If you do not agree, do not proceed with the affected feature or purchase. You can contact support for clarification before deciding.

Acceptance is not consent to train AI on any user data, permission to publish private inputs, or a waiver of rights that cannot lawfully be waived. It also does not replace a separate choice or consent that the law requires. Keep the information relevant to a transaction if you may need it later, and use the support and rights routes in these pages if something does not match what was agreed.
